What AVBase does
AVBase operates as a search index for torrent metadata published by third-party providers. We do not host, store, cache, or distribute media files. Consequently, our enforcement capabilities are limited to (a) suppressing search results on our platform, and (b) forwarding valid infringement notices to the originating upstream indexer.
Filing a Notice
In accordance with 17 U.S.C. § 512(c)(3), a valid takedown notice must contain the following six elements. Deficient notices may be rejected.
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed (or a representative list of works).
- Identification of the allegedly infringing material, along with information reasonably sufficient to allow us to locate it (providing the specific info-hash, title, or upstream URL is recommended).
- Contact details, including email address, mailing address, and telephone number.
- A statement that the complaining party has a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notification is accurate and that the complaining party is authorized to act on behalf of the copyright owner.
Our Response
- Acknowledge the notice within a few business days.
- Suppress the specific listing from search results.
- Forward the notice to the originating upstream indexer when feasible.
Counter-Notification
If you believe your listing was suppressed in error, you may submit a written counter-notification pursuant to 17 U.S.C. § 512(g)(3). The counter-notification must include your signature, identification of the removed material, a statement under penalty of perjury, and consent to the jurisdiction of the federal court in your district.
Designated Agent
Because AVBase does not host media content, we do not maintain a designated copyright agent or an on-site notice form. Valid takedown notices are forwarded to the upstream indexer (sukebei.nyaa.si) when feasible, and the corresponding listing is suppressed from search results.
